Couple with Surrogate Mother

Surrogacy

What Is Surrogacy?

Surrogacy is where a woman, known as a surrogate, carries a pregnancy for a couple, referred to as the intended parents.

Types of Surrogacy

Gestational Surrogacy

This is the only form of surrogacy legally permitted in India. In this arrangement, the surrogate carries a baby conceived using an embryo created exclusively from the intended mother’s egg and the intended father’s sperm. The use of donor eggs or donor sperm for creating an embryo in a surrogacy journey is not permitted. This ensures the child is genetically related to both intending parents. The surrogate has no genetic link to the baby she carries. At FERTY9, we specialize in guiding families through gestational surrogacy, ensuring clarity and peace of mind for everyone involved.

When Surrogacy Is Recommended

Surrogacy can be the right path for:

  • Women who have medical conditions that make pregnancy unsafe (e.g., severe heart disease or uterine issues).
  • Women who were born without a uterus or have had it surgically removed (hysterectomy).
  • Individuals or couples who have experienced recurrent pregnancy loss or failed IVF attempts.

Eligibility Criteria

To ensure a safe and successful journey, we follow clear eligibility criteria for everyone involved.

  • Intended Parents
    • Medical Indications: A clear medical reason for needing surrogacy is required.
    • Age and Health Conditions: We assess the overall health of intended parents to ensure they are prepared for the journey and for raising a child.
    • Legal Requirements: Intended parents must be prepared to meet all legal obligations, including establishing parentage. Our team will guide you through this process.
  • Surrogates
    • Health, Age, and Lifestyle: Surrogates must meet specific age and health guidelines, have a healthy BMI, be non-smokers, and have had at least one previous living child.
    • Psychological Screening: A thorough psychological evaluation is conducted to ensure they are emotionally prepared for the process.
    • Consent and Legal Agreements: All parties must provide informed consent and enter into legally binding agreements to protect the rights of everyone involved.

Step-by-Step Surrogacy Process

At FERTY9, we strictly adhere to the laws of India, which permit only Altruistic Surrogacy. This is a selfless and compassionate approach where a surrogate, typically a close relative or friend of the intended parents, agrees to help without any financial compensation beyond the coverage of medical expenses and a comprehensive insurance policy. Our process is designed to ensure care, transparency, and legal compliance for everyone involved.

  1. Initial Consultation: Meet with our fertility specialists and support team. We will discuss your needs, explain the altruistic surrogacy framework in detail, and create a personalized plan for your journey to parenthood.
  2. Surrogate Screening and Evaluation: Once an altruistic surrogate has been identified, she undergoes a comprehensive screening process to ensure she is physically and emotionally prepared for the journey. This includes a full medical and gynaecological evaluation, blood tests for infectious diseases, and psychological counselling and assessment.
  3. Legal Agreements: Our legal experts will help you and your surrogate draft and sign a comprehensive, legally binding surrogacy agreement. This document outlines the rights and responsibilities of all parties and ensures the entire process complies with the guidelines of the Surrogacy (Regulation) Act.
  4. Embryo Creation and Transfer: An embryo is created using the intended parents’ (or a donor’s) gametes via IVF. Once the surrogate is medically cleared and her cycle is synchronized, the healthy embryo is transferred to her uterus.
  5. Pregnancy Monitoring and Delivery: We work closely with the surrogate’s local doctor to monitor the pregnancy meticulously, ensuring the health and well-being of both the surrogate and the baby. We celebrate with you as you legally and emotionally welcome your child into the world.

Benefits of Surrogacy

  • High Success Rates: Using healthy, screened surrogates often leads to higher success rates compared to other fertility treatments.
  • Emotional Fulfillment: The journey creates a unique and powerful bond, bringing immense joy and fulfillment to intended parents and surrogates alike.

Benefits of Altruistic Surrogacy in India

While the decision to pursue surrogacy comes from a place of medical necessity, the legally supported path in India offers its own unique and powerful advantages.

  • A Path to Your Biological Child For couples who are unable to carry a pregnancy, altruistic surrogacy is the sole path to having a child that is genetically their own. The law mandates that the baby must be conceived from the intended mother’s egg and father’s sperm, preserving your biological legacy.
  • A Journey Built on Trust and Family The legal requirement for the surrogate to be a “close relative” ensures the journey is founded on love and trust. This avoids the uncertainties of commercial arrangements and allows the profound act of creating a family to happen within a supportive, known family environment.
  • Clear Legal and Medical Security The Surrogacy (Regulation) Act, 2021 provides a secure framework that legally protects the rights of the child and establishes the intending parents as the legal parents from conception. The mandatory, thorough medical screening also ensures the utmost safety and well-being for your surrogate.

FAQ's

What is the success rate of surrogacy?
The success rate of surrogacy in India is favorable because the embryo is transferred into a healthy, medically screened surrogate. However, the final outcome depends entirely on the quality of the embryo created from the intending mother's egg and the intending father's sperm. The age and health of the intending parents are the most crucial factors, as the use of donor gametes in surrogacy is not permitted.
Can we meet our surrogate?
Yes. Under the current law, surrogacy in India must be altruistic, which requires the surrogate to be a willing close relative of the intending couple.
How long does the entire process take?
From the start of the clinical process, the entire surrogacy journey takes approximately 12 to 14 months. This includes 3 to 4 months for all the necessary legal and medical preparations, followed by the 9-month pregnancy.
What legal documents are needed?
The two main documents are a Surrogacy Agreement, signed before treatment, and a Parental Order, filed after birth to name you as the legal parents. Our team guides you through all legal steps.
